Terms of Service

These Terms of Service (“Terms”) govern your use of RentWorks, including the web application at app.rentworks.pro, the RentWorks mobile application, this website, and related services (together, the “Service”). The Service is provided by Oribicom Limited (“Oribicom”, “we”, “us” or “our”).

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms for it, and “you” refers to that organisation.

1. The Service

RentWorks is software for managing rental property. It lets you record properties, units, tenants, rental agreements, rent invoices, payments, expenses and related information, and produce documents such as invoices, receipts and agreements.

RentWorks is a record-keeping and management tool. RentWorks does not collect, hold or transfer rent on your behalf, and is not a bank, payment institution, estate agent, or legal, tax or financial adviser. Documents produced by the Service, including rental agreements, are based on information you enter; you are responsible for making sure they are suitable for your circumstances.

2. Accounts

• You must provide accurate information when creating an account and keep it up to date.
• You are responsible for keeping sign-in credentials confidential and for all activity under your account, including activity by users you add.
• You must tell us promptly at info@rentworks.pro if you believe your account has been accessed without authorisation.

3. Free trial

New accounts may receive a free trial period. The length and scope of any trial are shown when you sign up and may change for new accounts. At the end of the trial, continued use of the Service requires a paid subscription.

4. Subscriptions and fees

• Subscription fees are charged per rental unit licensed to your account, for the billing period you choose. Current prices are published at rentworks.pro/pricing and shown in the application before you pay.
• The billing currency depends on the company currency recorded for your account.
• Adding units beyond your licensed number requires additional unit licences.
• Subscriptions are prepaid. Unless required by law or stated otherwise in writing, fees already paid are not refundable, including for unused units or time.
• If a subscription expires, access to some or all features may be restricted until it is renewed.
• We may change prices for future billing periods. We will give reasonable notice before a price change affects you.

5. Payments

Subscription payments are processed by third-party payment providers, for example mobile money operators, card processors or an app store. Your use of those payment methods is also subject to the provider's own terms. We are not responsible for delays or failures caused by a payment provider.

6. Your data

• You keep ownership of the information you enter into RentWorks (“Your Data”). You give us permission to host, process and display Your Data only as needed to provide and support the Service.
• You are responsible for Your Data, including having an appropriate legal basis to record information about tenants and other individuals, and for complying with applicable data-protection laws.
• Our handling of personal information is described in our Privacy Policy.
• You can export records from the Service. We recommend keeping your own copies of important records.

7. Acceptable use

You agree not to:

• use the Service for anything unlawful, fraudulent or harmful;
• upload material you have no right to use, or that contains malware;
• attempt to access another customer's data or any part of the Service you are not authorised to access;
• interfere with, overload or disrupt the Service, or bypass licensing or security controls;
• copy, resell or reverse-engineer the Service except where the law allows it; or
• use the Service to harass tenants or other people, including through reminders sent from the Service.

8. Intellectual property

The Service, including its software, design and the RentWorks name and logo, belongs to Oribicom Limited or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No other rights are granted.

If you send us feedback or suggestions, we may use them without obligation to you.

9. Availability and changes

We work to keep the Service available and reliable, but we do not promise that it will be uninterrupted or error-free. We may carry out maintenance, and we may change, add or remove features over time. If we remove a significant feature you rely on, we will try to give reasonable notice.

10. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Figures, balances and documents shown by the Service depend on the accuracy of the information entered, and you should check them before relying on them.

11. Limitation of liability

To the extent permitted by law:

• we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, rent, data or goodwill; and
• our total liability arising out of or relating to the Service is limited to the fees you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Suspension and termination

You may stop using the Service at any time and may request deletion of your account as described in the Privacy Policy. We may suspend or close an account that breaches these Terms, that is used unlawfully, or where required by law. Where reasonable, we will tell you first and give you an opportunity to put things right.

After an account is closed, we may delete Your Data in line with our retention practices, except where we must keep it by law.

13. Governing law

These Terms are governed by the laws of the Republic of Zambia. Before starting formal proceedings, both parties agree to try in good faith to resolve any dispute by contacting each other.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the effective date. If a change is material, we will give reasonable notice, for example by email or in the application. Continuing to use the Service after a change takes effect means you accept the updated Terms.
